ALGEMENE VOORWAARDEN FOREVER RUNNING – NL

Deze termen en servicevoorwaarden gelden voor www.foreverrunning.nl (“de website”). Ze zijn ook van toepassing op het gebruik van alle mogelijke informatie, documenten, grafisch materiaal, films, elementen, muziek en/of diensten van elk van de websites.

De website is eigendom van en wordt geëxploiteerd door of namens Forever Running, Aartsdijkweg 107, 2676 LE, Maasdijk, Nederland met VAT No. NL84030003B.01 (KvK No. 84030003). (“FOREVER RUNNING”).

Door de plaatsing van een bestelling via deze website komt een koopovereenkomst tot stand tussen u (als consument) en FOREVER RUNNING. Op die overeenkomst zijn deze algemene termen en voorwaarden van toepassing; met name de hierna vermelde algemene verkoopvoorwaarden.

Termen en voorwaarden voor het online inkopen en het gebruiken van de website

1. TOEPASSING

Deze algemene voorwaarden zijn van toepassing op:
bestellingen van producten via de website door consumenten in Europa; en
het gebruik van alle gegevens, documenten, afbeeldingen, films, muziek of andere bijzonderheden en diensten van de website.

2. BESTELLINGEN

2.1. Voorwaarden voor het plaatsen van bestellingen
Voor het plaatsen van een bestelling via de website:
dient u minstens 16 jaar oud te zijn;
dient u een consument te zijn, geen distributeur.

2.2. Plaatsing van de bestelling
Met de plaatsing van uw bestelling gaat u een verplichting aan zodra u aan het einde van het inkoopproces op de knop “Kopen” heeft geklikt. Door op “Kopen” te klikken bevestigt u uw bestelling bij FOREVER RUNNING. Dit betekent dat u zich verplicht tot betaling van het bedrag dat is vermeld op het laatste scherm van het online aankoopproces. Zodra FOREVER RUNNING uw bestelling heeft ontvangen kont er een automatische ontvangstbevestiging op het scherm, met vermelding van het ordernummer en uw aankoopgegevens. Op dat moment is de koopovereenkomst formeel tot stand gekomen.
Er wordt vervolgens een automatische bevestiging van de bestelling naar uw e-mailadres gestuurd; ditzelfde geldt ook wanneer u later uw bestelling wijzigt en de wijziging door FOREVER RUNNING is geaccepteerd. FOREVER RUNNING raadt u aan om een kopie uit te printen of te downloaden voor mogelijke latere raadpleging.

2.3. Voorwaarden voor de bestelling
De levering van alle via de website gedane bestellingen zal afhankelijk zijn van de beschikbaarheid. FOREVER RUNNING behoudt zich het recht voor om uw bestelling niet te accepteren of om deze na de automatische bevestiging te annuleren in (onder andere) de hieronder genoemde volgende gevallen; FOREVER RUNNING zal daarbij zijn vrijgesteld van elke aansprakelijkheid voor schade, nadeel of kosten (alle gedane betalingen zullen worden teruggestort):
Als het product niet beschikbaar/niet op voorraad is.
Als uw factuurinformatie niet correct of niet verifieerbaar is.
Als uw bestelling door de beveiligingssystemen van FOREVER RUNNING wordt aangemerkt als ongebruikelijk of fraudegevoelig.
Als u jonger bent dan 16 jaar.
Als u distributeur bent.
Als er sprake is van een duidelijke vergissing in de aangeboden prijs.
Als FOREVER RUNNING de bestelling niet kon leveren op het opgegeven adres.
Als er sprake is van een kennelijke fout in de spelling of prijsaanduiding, of van andere vergissingen in de op de website geboden informatie.
Bovendien houdt FOREVER RUNNING zich het recht voor tot weigering van massale bestellingen verricht door geautomatiseerde systemen (bots of scripts), die een belemmering vormen voor de mogelijkheid van andere gebruikers om toegang te krijgen tot onze aanbiedingen en producten.

2.4. Controle van de gegevens
Wanneer u bij FOREVER RUNNING uw bestelling plaatst, kan FOREVER RUNNING, alvorens de order te verwerken, een aantal controles uitvoeren. Deze controles kunnen onder andere zijn gericht op het natrekken van uw adres en uw kredietwaardigheid en op de bestrijding van fraude. Met betrekking tot dit laatste: FOREVER RUNNING verricht gedeeltelijk automatische controles van alle aankopen, ter identificatie van ongebruikelijke of verdachte transacties of transacties die mogelijk zouden kunnen worden aangemerkt als fraude. Bij vermoedens van fraude op de website zal nader onderzoek volgen en indien nodig zullen gerechtelijke stappen worden genomen.

3. KWALITEIT EN ONDERHOUD VAN DE PRODUCTEN

Het is mogelijk dat zich kleine verschillen voordoen in de kleur of andere kenmerken van de producten, die te wijten zijn aan de digitalisering van de afbeeldingen, de gebruikte weergavetechnologie of andere mogelijke technische oorzaken. FOREVER RUNNING zal voor dergelijke variaties of afwijkingen niet aansprakelijk zijn.

FOREVER RUNNING adviseert om aandacht besteden aan de wasvoorschriften en aanwijzingen voor onderhoud, die zijn afgedrukt op de etiketten van de producten. FOREVER RUNNING zal niet aansprakelijk zijn voor enige vorm van schade ten gevolge van onjuiste omgang met de producten of elke mogelijke handeling in strijd met de aanwijzingen.

4. PRIJS

Hoewel FOREVER RUNNING al het mogelijke doet om ervoor te zorgen dat alle gegevens, beschrijvingen en prijzen die zijn weergegeven op de website correct zijn, kunnen zich fouten voordoen. Indien FOREVER RUNNING vaststelt dat er een fout is opgetreden in de prijsvermelding van een product dat u hebt besteld, zal FOREVER RUNNING u zo spoedig mogelijk van de fout op de hoogte brengen en u de mogelijkheid bieden om uw bestelling opnieuw te bevestigen tegen de juiste prijs, of om deze te annuleren. Als FOREVER RUNNING niet in staat is contact met u op te nemen, zal de bestelling worden afgehandeld als geannuleerd. Indien u annuleert maar de producten reeds betaald heeft, ontvangt u het volledige betaalde bedrag terug. De prijzen zijn wanneer van toepassing inclusief BTW. De verzendkosten worden apart aangerekend.

5. BETALING

Na ontvangst van uw bestelling zal FOREVER RUNNING voorafgaande aan de bevestiging een standaardcontrole uitvoeren van uw betaalkaart, om zich ervan te verzekeren dat er voldoende saldo beschikbaar is voor de beoogde transactie. De producten zullen niet eerder worden verzonden dan nadat deze ter bevestiging vereiste controle verricht is. Zodra de betalingsopdracht is verwerkt zal het bedrag van uw betaalkaart worden afgeboekt.

6. VERSTURING EN LEVERANTIE

6.1. Leverantie
Leveringen worden gedaan van maandag t/m vrijdag. FOREVER RUNNING zal op bepaalde feestdagen bestellingen niet kunnen leveren. FOREVER RUNNING kan uitsluitend bestellingen versturen naar afleveringsadressen van huizen of kantoren in een van de landen die zijn vermeld op de landenlijst op de website.

6.2. Afzonderlijke levering
Voor zover mogelijk zal FOREVER RUNNING altijd proberen om alle bestelde producten samen af te leveren. FOREVER RUNNING behoudt zich het recht voor om de levering van uw bestellingen te splitsen.

6.3. Controle bij aflevering
Controleer bij aflevering of het pakket niet beschadigd is. Accepteer de leverantie niet als u vaststelt dat de producten beschadigd zijn.

6.4. Verzendkosten
De tarieven voor de verzendkosten kunnen aan wijziging onderhevig zijn en zullen worden vermeld in de samenvatting van uw bestelling. Nadat de bestelling formeel is bevestigd zullen deze tarieven blijven gehandhaafd.

Het kan zijn dat gratis verzending geboden wordt.

7. TERUGGAVEN EN ANNULERINGEN

7.1. Annulering van uw bestelling vóór de levering van het product
Na de formele bevestiging van de aankoop kan de bestelling niet meer worden geannuleerd. Nochtans kunt u in overeenstemming met de geldende wetgeving gebruik maken van uw herroepingsrecht middels een e-mail naar [info@FOREVERRUNNING.nl].

7.2. Retourzendingen na levering. Producten met gebreken
Indien de producten bij aflevering gebreken vertonen of niet overeenkomen met uw bestelling heeft u het recht om het geleverde terug te zenden. U beschikt hiertoe over 2 maanden na het aantreffen van het defect. Dit is onverminderd uw wettelijke rechten. Indien uw klacht gegrond is, krijgt u de aankoopprijs en de verzendkosten terugbetaald. 7.3. Uitoefening van het herroepingsrecht
Als u om welke reden dan ook niet tevreden bent met de producten die u besteld heeft, kunt u de geleverde waren, zonder opgave van redenen, binnen 30 kalenderdagen terugsturen, op voorwaarde dat ze niet gewassen en op geen enkele wijze in gebruik geweest zijn.

Producten waaraan iets veranderd is – verzegelde producten met geluids- of video-opnames of verzegelde computerprogramma’s of audiovisuele producten waarvan het zegel verbroken is – kunnen niet worden teruggestuurd.

Wanneer u FOREVER RUNNING ervan verwittigt dat u een product wilt terugsturen, zal FOREVER RUNNING alle betaalde bedragen, met inbegrip van de verzendkosten (met uitzondering van eventuele meerkosten die werden gemaakt als gevolg van uw keuze voor een andere dan de goedkoopste door ons aangeboden standaardlevering, voor zover de toepasselijke wetgeving dit toelaat), terugstorten, in elk geval binnen een termijn van uiterlijk 15 dagen vanaf de datum waarop u FOREVER RUNNING in kennis stelt van uw beslissing om gebruik te maken van uw herroepingsrecht. FOREVER RUNNING kan de terugbetaling opschorten, hetzij totdat de producten terug ontvangen zijn, hetzij totdat aan FOREVER RUNNING is aangetoond dat de terugsturing is verricht, al naar gelang hetgeen zich het eerste voordoet.

7.4. Producten ruilen
Producten kunnen niet worden geruild, maar u heeft de mogelijkheid het gekochte product terug te sturen. Om het product in een andere kleur of maat te kunnen krijgen dient u op de website een nieuwe bestelling te plaatsen.

7.5. Informatie over de terugbetaling
De wijze van terugbetaling is afhankelijk van hoe de betaling van het product verricht werd. Indien u de betaling verrichtte via een bankoverschrijving dient u dit aan de klantenservice te vermelden wanneer u het product terugstuurt, zodat het bedrag rechtstreeks kan worden teruggestort op uw rekening. U ontvangt de terugbetaling zodra het product is geretourneerd en de terugzending is verwerkt.

Indien de retourzending plaatsheeft om andere redenen dan wegens gebreken of het niet in overeenstemming zijn met de gedane bestelling, dient u de verzendkosten voor de retourzending zelf te betalen.

8. AANSPRAKELIJKHEID

Als FOREVER RUNNING handelt in strijd met deze voorwaarden, aanvaardt zij de aansprakelijkheid voor mogelijk verlies, schade of nadeel ontstaan als voorzienbaar gevolg van de niet-naleving van deze algemene voorwaarden of de door FOREVER RUNNING begane nalatigheid. Verlies of schade geldt als voorzienbaar als deze een duidelijk gevolg is van de wanprestatie van FOREVER RUNNING of indien deze als zodanig door u en FOREVER RUNNING werd voorzien op het moment van formalisering van de koopovereenkomst, voor zover toegestaan door de toepasselijke wetgeving.

Hoewel FOREVER RUNNING de website met zorg heeft samengesteld kunnen zich in de informatie, teksten, documenten, afbeeldingen, films, muziek en diensten op de site fouten, onnauwkeurigheden of onvolkomenheden voordoen. FOREVER RUNNING blijft gevrijwaard van elke aansprakelijkheid voor enige schade of nadeel ten gevolge van het gebruik of (of de onmogelijkheid van gebruik) van de website, inbegrepen schade door virussen of ander vanuit technologisch oogpunt schadelijk materiaal dat uw computeruitrusting zou kunnen infecteren of uw programma’s, gegevens of andere materiaal van uw eigendom zou kunnen beschadigen door gebruik van de website of downloaden van enige inhoud daarvan, of indien er onnauwkeurigheden of onvolkomenheden voorkomen op de website. Hoewel we gebruikmaken van gecodeerde beveiligingssoftware, kan de veiligheid van via Internet of e-mail verstuurde informatie of betalingen niet worden gegarandeerd. FOREVER RUNNING zal niet aansprakelijk zijn voor enige schade of nadeel geleden ten gevolge van het gebruik van elektronische communicatie.

Indien u schade of nadeel heeft geleden ten gevolge van activiteiten van FOREVER RUNNING in verband met de aankoop van onze producten via de website, zal de aansprakelijkheid van FOREVER RUNNING beperkt blijven tot:

schade en nadeel aan producten van FOREVER RUNNING of aan ander materiaal;

redelijke en aantoonbare kosten die werden gemaakt ter vaststelling van de oorzaak en de omvang van de schade en het nadeel, in overeenstemming met het gestelde sub a);

redelijke en aantoonbare kosten die werden gemaakt ter voorkoming of beperking van schade en nadeel, in overeenstemming met het gestelde sub a).

De maximale vergoeding van de schade en het nadeel als boven vermeld wordt (voor zover van toepassing) gesteld op het bedrag van de aankoopprijs van de getroffen producten, voor zover toegestaan door de toepasselijke wetgeving.

FOREVER RUNNING zal niet aansprakelijk zijn voor schade en nadeel van een derde die voortvloeit uit het gebruik van een van haar producten. FOREVER RUNNING zal niet aansprakelijk zijn voor schade en nadeel geleden door u ten gevolge van het gebruik van een van haar producten.

Niets van hetgeen is vermeld in deze algemene voorwaarden houdt uitsluiting of beperking in van de aansprakelijkheid van FOREVER RUNNING voor overlijden of persoonlijk letsel veroorzaakt door nalatigheid, fraude of een bedrieglijke verklaring van haar zijde, noch van enige andere aansprakelijkheid die volgens de Nederlandse wet niet kan worden uitgesloten of beperkt.

Voor zover het toepasselijk recht dit toestaat, sluit FOREVER RUNNING alle voorwaarden, garanties, verklaringen of andere bepalingen die van toepassing zouden kunnen zijn op de website of elke mogelijke expliciete of impliciete inhoud daarvan uit.

Merk op dat FOREVER RUNNING de website uitsluitend heeft bedoeld voor huishoudelijk en particulier gebruik. U gaat ermee akkoord de website niet te gebruiken voor commerciële of zakelijke doeleinden en wij zijn vrijgesteld van elke aansprakelijkheid tegenover u voor gederfde inkomsten, verlies van zakelijke activiteiten, onderbreking van verkoop of verlies van handelsmogelijkheden.

9. INTELLECTUELE EIGENDOMSRECHTEN

FOREVER RUNNING is eigenaar van alle intellectuele eigendomsrechten van de website en van al het daarop gepubliceerde materiaal. Alle inhoud wereldwijd beschermd door auteursrechten. Al deze rechten zijn voorbehouden.

U kunt een kopie afdrukken of uittreksels van elke page van de website afdrukken enkel en alleen wanneer dit is vereist voor het plaatsen van een bestelling bij FOREVER RUNNING of om gebruik te kunnen maken van de website voor het doen van aankopen.

U mag geen enkele wijziging aanbrengen op papier, noch in de digitale kopieën van elk mogelijk materiaal dat u heeft afgedrukt of gedownload, noch gebruikmaken van enige afbeelding, foto, video of audiofragment, nog van enige mogelijke grafiek, onafhankelijk en los van de daarbij behorende tekst.

De eigendom van FOREVER RUNNING van de inhoud van de website moet te allen tijde worden erkend.

Het is niet toegestaan gebruik te maken van de inhoud van de website voor handelsdoeleinden zonder de desbetreffende toestemming van FOREVER RUNNING.

Indien u een willekeurig deel van de website uitprint, kopieert of downloadt en de onderhavige algemene voorwaarden niet naleeft, komt daarmee onmiddellijk een einde aan uw recht om gebruik te naken van de website en dient u indien daartoe door ons verzocht alle door u van het materiaal gemaakte kopieën terug te geven of te vernietigen.

10. BESCHIKBAARHEID VAN DE WEBSITE

FOREVER RUNNING garandeert niet dat de website of de inhoud daarvan altijd en ononderbroken beschikbaar zal zijn. De toestemming tot toegang tot de site wordt verleend op tijdelijke grondslag. FOREVER RUNNING kan het geheel of een deel van de website opschorten, verwijderen, onderbreken of veranderen zonder voorafgaande kennisgeving. FOREVER RUNNING zal zijn vrijgesteld van elke aansprakelijkheid als om welke reden dan ook de website op enig moment of gedurende een bepaalde periode niet beschikbaar is.

11. UW ACCOUNT EN WACHTWOORD

Als u kiest voor registratie op de website moet u ervoor zorgen dat uw gebruikersnaam en wachtwoord geheim blijven en niet aan derden bekend worden gemaakt.

FOREVER RUNNING heeft het recht om iedere identificatiecode of wachtwoord van een gebruiker, of deze nu door de gebruiker zelf is gekozen danwel door FOREVER RUNNING is toegewezen, te annuleren wanneer u naar het billijk oordeel van FOREVER RUNNING een van de bepalingen van de onderhavige algemene gebruiksvoorwaarden overtreden heeft.

12. WIJZIGING VAN DE ALGEMENE VOORWAARDEN.

FOREVER RUNNING kan deze voorwaarden bij gelegenheid herzien. Bij het bestellen van producten zijn de op dat moment geldende algemene voorwaarden van toepassing op de overeenkomst tussen u en FOREVER RUNNING.

FOREVER RUNNING zal u informeren wanneer deze algemene voorwaarden worden herzien middels een bericht betreffende de veranderingen met vermelding van de datum van ingang daarvan aan de bovenkant van deze webpage.

13. ANDERE BELANGRIJKE VOORWAARDEN

FOREVER RUNNING kan haar rechten en plichten uit hoofde van een contract overdragen aan elke mogelijke andere organisatie, maar dit heeft geen gevolgen voor onze rechten of verplichtingen uit hoofde van deze algemene voorwaarden.

U mag uw rechten en verplichtingen uit hoofde van deze algemene voorwaarden uitsluitend overdragen indien u daartoe van FOREVER RUNNING schriftelijke toestemming heeft gekregen.

Elk lid van deze algemene voorwaarden zal onafhankelijk van toepassing zijn. Indien een rechter of bevoegde autoriteit besluit dat een van de leden van de overeenkomst ongeldig of niet afdwingbaar is, blijven de overige termen en voorwaarden onverminderd van kracht.

Indien FOREVER RUNNING een van de verplichtingen onder deze voorwaarden niet afdwingt of geen gebruik maakt van haar rechten tegenover u, of indien zij met gebruikmaking van die rechten wacht, betekent dat niet dat zij daarmee afstand doet van haar rechten tegenover u, noch dat u niet gehouden bent tot naleving van uw verplichtingen. Indien FOREVER RUNNING afstand doet van haar rechten in geval van wanprestatie van uw zijde, zal zij dit alleen schriftelijk doen en zal dit niet betekenen dat zij daarmee ook afziet van haar rechten bij mogelijke latere tekortkomingen van uw zijde.

14. TOEPASBAAR RECHT

Deze algemene voorwaarden en alle uit deze algemene voorwaarden voortvloeiende geschillen, met inbegrip van geschillen betreffende de geldigheid daarvan of voortvloeiende uit het gebruik van de website of uit elke mogelijke aankoop via de website, vallen onder Nederlands recht.

By placing an order through this website a purchase agreement comes into being between you (as consumer) and FOREVER RUNNING. To that agreement, these general terms and conditions apply; in particular, the general sales conditions listed below.

Terms and conditions for online purchasing and use of the website.

1. APPLICATION

These general terms and conditions apply to:
orders of products through the website by consumers in Europe and
the use of any data, documents, images, films, music or other details and services from the website.

2. ORDERS

2.1 Conditions for placing orders
To place an order through the website:

you must be at least 18 years old;

you must be a consumer, not a distributor

2.2. Placement of the order
By placing your order, you are making a commitment once you click on the “Buy” button at the end of the purchasing process. By clicking on “Buy” you confirm your order with FOREVER RUNNING. This means that you commit to pay the amount listed on the last screen of the online purchasing process. As soon as FOREVER RUNNING has received your order, an automatic receipt will appear on the screen, indicating the order number and your purchase details. At that point the purchase agreement has been formally concluded.

An automatic order confirmation is then sent to your e-mail address; the same also applies if you later change your order and the change has been accepted by FOREVER RUNNING. FOREVER RUNNING recommends that you print out or download a copy for possible future reference.

2.3. Terms and conditions of the order
Delivery of all orders made through the website will be subject to availability. FOREVER RUNNING reserves the right not to accept your order or to cancel it after its automatic confirmation in (among others) the following cases listed below; FOREVER RUNNING will thereby be released from any liability for damages, harm or costs (all payments made will be refunded):

If the product is not available/not in stock.
If your billing information is incorrect or not verifiable.
If your order is flagged by FOREVER RUNNING’s security systems as unusual or fraudulent.
If you are under 18 years of age.
If you are a distributor
If there is an obvious error in the price offered.
If FOREVER RUNNING could not deliver the order to the address given.
If there is a manifest error in spelling or price indication, or other errors in the information offered on the website.
In addition, FOREVER RUNNING reserves the right to refuse mass orders made by automated systems (bots or scripts), which impede the ability of other users to access our offers and products.

2.4. Control of data
When you place your order with FOREVER RUNNING, FOREVER RUNNING may, before processing the order, carry out a number of checks. These checks may be aimed, among other things, at verifying your address and your creditworthiness and at combating fraud. With respect to the latter: FOREVER RUNNING performs partially automatic checks of all purchases, in order to identify unusual or suspicious transactions or transactions that could possibly be classified as fraud. In case of suspicion of fraud on the website, further investigation will follow and, if necessary, legal action will be taken.

3. QUALITY AND MAINTENANCE OF THE PRODUCTS

It is possible that slight variations may occur in the color or other characteristics of the products, due to the digitization of the images, the display technology used or other possible technical causes. FOREVER RUNNING will not be liable for such variations or deviations.

FOREVER RUNNING recommends paying attention to the washing instructions and directions for maintenance, which are printed on the labels of the products. FOREVER RUNNING will not be liable for any damage resulting from improper handling of the products or any possible act contrary to the instructions.

4. PRICE

Although FOREVER RUNNING makes every effort to ensure that all data, descriptions and prices displayed on the website are correct, errors may occur. If FOREVER RUNNING determines that an error has occurred in the pricing of a product you have ordered, FOREVER RUNNING will notify you of the error as soon as possible and offer you the opportunity to reconfirm your order at the correct price, or to cancel it. If FOREVER RUNNING is unable to contact you, the order will be handled as cancelled. If you cancel but have already paid for the products, you will receive a full refund of the amount paid. Prices are inclusive of VAT where applicable. Shipping costs are charged separately.

5. PAYMENT

Upon receipt of your order, FOREVER RUNNING will perform a standard check of your payment card prior to confirmation, to ensure that sufficient funds are available for the intended transaction. The products will not be dispatched until this check required for confirmation has been carried out. Once the payment order has been processed, the amount will be debited from your payment card.

6. SHIPMENT AND DELIVERY

6.1. Delivery
Deliveries are made from Monday to Friday. FOREVER RUNNING will not be able to deliver orders on certain holidays. FOREVER RUNNING can only ship orders to delivery addresses of homes or offices in one of the countries listed in the country list on the website.

6.2. Individual delivery
As far as possible, FOREVER RUNNING will always try to deliver all products ordered together. FOREVER RUNNING reserves the right to split the delivery of your orders.

6.3. Checking on delivery
Upon delivery, check that the package is not damaged. Do not accept the delivery if you find that the products are damaged.

6.4. Shipping costs
The rates for shipping costs may be subject to change and will be stated in the summary of your order. After the order is formally confirmed these rates will continue to apply.

Free shipping may be offered.

7. RETURNS AND CANCELLATIONS

7.1. Cancellation of your order before delivery of the product
After the formal confirmation of the purchase, the order cannot be cancelled. However, you may exercise your right of withdrawal in accordance with the legislation in force by sending an e-mail to [info@foreverrunning.nl].

7.2. Returns after delivery. Defective products
If, upon delivery, the products show defects or do not correspond to your order, you have the right to return the delivered products. You have 2 months after the discovery of the defect. This is without prejudice to your statutory rights. If your complaint is justified, you will be refunded the purchase price and the shipping costs. For more information on how to return your order, please consult the help section of the website. (so we have to make those too)

7.3. Exercise of the right of withdrawal
If for any reason you are not satisfied with the products you have ordered, you may return the goods delivered, without giving any reason, within 30 calendar days, provided that they have not been washed and have not been used in any way. Returned products where demonstrable signs of use are found will not be accepted and the purchase price and shipping costs will not be refunded.

When you notify FOREVER RUNNING that you wish to return a product, FOREVER RUNNING will refund all amounts paid, including shipping costs (with the exception of any additional costs incurred as a result of your choice of a standard delivery other than the least expensive one offered by us, to the extent permitted by applicable law), refund them, in any case within a period of no more than 15 days from the date when you notify FOREVER RUNNING of your decision to exercise your right of withdrawal. FOREVER RUNNING may suspend reimbursement if the products have not yet been received back, or until it has been demonstrated to FOREVER RUNNING that the return has been made, whichever occurs first.

7.4. Exchanging products
Products cannot be exchanged, but you have the option of returning the purchased product. In order to get the product in a different color or size, you must place a new order on the website.

7.5. Refund information.
The method of refund depends on how the payment of the product was made. If you paid for the product by bank transfer, you must inform the customer service department when you return the product so that the amount can be refunded directly to your account. You will receive the refund as soon as the product has been returned and the return has been processed.

If the return takes place for reasons other than defects or not conforming to the order made, you will have to pay the return shipping costs yourself.

8. LIABILITY

If FOREVER RUNNING acts in breach of these terms and conditions, it accepts liability for possible loss, damage or harm caused as a foreseeable consequence of the failure to comply with these terms and conditions or the negligence committed by FOREVER RUNNING. Loss or damage is considered foreseeable if it is a clear consequence of FOREVER RUNNING’s default or if it was foreseen as such by you and FOREVER RUNNING at the time of formalization of the purchase agreement, to the extent permitted by applicable law.

Although FOREVER RUNNING has compiled the website with care, the information, texts, documents, images, films, music and services on the site may contain errors, inaccuracies or imperfections. FOREVER RUNNING remains indemnified from any liability for any damages or harm resulting from the use or (or inability to use) the website, including damages caused by viruses or other technologically harmful material that could infect your computer equipment or damage your programs, data or other material of your property by using the website or downloading any content thereof, or if any inaccuracies or imperfections appear on the website. Although we use encrypted security software, the security of information or payments sent via the Internet or e-mail cannot be guaranteed. FOREVER RUNNING will not be liable for any damage or harm suffered as a result of the use of electronic communications.

If you have suffered damage or harm as a result of FOREVER RUNNING’s activities in connection with the purchase of our products through the website, FOREVER RUNNING’s liability will be limited to:

damage and harm to FOREVER RUNNING products or other material;
reasonable and demonstrable costs incurred in establishing the cause and extent of the damage and disadvantage, in accordance with subsection a);
reasonable and demonstrable costs incurred to prevent or limit damage and disadvantage, in accordance with the provisions under a).
The maximum compensation for damage and harm as stated above is set (as applicable) at the amount of the purchase price of the affected products, to the extent permitted by applicable law.

FOREVER RUNNING will not be liable for damages and disadvantage of a third party resulting from the use of one of its products. FOREVER RUNNING will not be liable for damages and harm suffered by you as a result of the use of any of its products.

Nothing contained in these General Terms and Conditions shall exclude or limit FOREVER RUNNING’s liability for death or personal injury caused by negligence, fraud or a fraudulent statement on its part, nor any other liability that cannot be excluded or limited under Dutch law.

To the extent permitted by applicable law, FOREVER RUNNING excludes all conditions, warranties, representations or other terms that might apply to the website or any possible express or implied content thereof.

Please note that FOREVER RUNNING has intended the website for domestic and private use only. You agree not to use the website for commercial or business purposes and we are exempt from any liability to you for lost revenue, loss of business, interruption of sales or loss of business opportunities.

9. INTELLECTUAL PROPERTY RIGHTS

FOREVER RUNNING owns all intellectual property rights to the website and all material published on it. All content is protected by copyright worldwide. All these rights are reserved.

You may print a copy or extracts of any page of the website only when required to place an order with FOREVER RUNNING or to use the website to make purchases.

You may not make any changes on paper or in the digital copies of any possible material you have printed or downloaded, nor use any image, photo, video or audio clip, nor any possible graphics, independently and separately from the accompanying text.

The ownership of FOREVER RUNNING of the contents of the website must be recognized at all times.

It is not permitted to use the contents of the website for commercial purposes without the relevant consent of FOREVER RUNNING.
If you print out, copy or download any part of the website and fail to comply with these General Terms and Conditions, your right to use the website ends immediately and you must return or destroy all copies of the material made by you if requested to do so by us.

10. AVAILABILITY OF THE WEBSITE

FOREVER RUNNING does not guarantee that the website or its contents will be available at all times and without interruption. Permission to access the site is granted on a temporary basis. FOREVER RUNNING may suspend, remove, interrupt or modify all or part of the website without notice. FOREVER RUNNING will be exempt from any liability if for any reason the website is unavailable at any time or for any period.

11. YOUR ACCOUNT AND PASSWORD

FOREVER RUNNING has the right to cancel any user identification code or password, whether chosen by the user or assigned by FOREVER RUNNING, if in FOREVER RUNNING’s reasonable opinion you have violated any of the provisions of these General Terms of Use.
If you know or suspect that someone other than yourself is familiar with your username or password you must notify the customer service of FOREVER RUNNING, Aartsdijkweg 107, 2676 LE Maasdijk, The Netherlands, with VAT No. NL84030003B.01 (KvK No. 84030003).

12. MODIFICATION OF THE GENERAL CONDITIONS

FOREVER RUNNING may revise these terms and conditions on occasion. When ordering products, the general terms and conditions in force at the time will apply to the contract between you and FOREVER RUNNING.
FOREVER RUNNING will inform you when these general terms and conditions are revised by means of a notice of the changes stating the effective date at the top of this webpage.

13. OTHER IMPORTANT CONDITION

FOREVER RUNNING may assign its rights and obligations under a contract to any other possible organization, but this does not affect our rights or obligations under these General Terms and Conditions.
You may transfer your rights and obligations under these General Terms and Conditions only if you have received written consent from FOREVER RUNNING to do so.
Each paragraph of these general terms and conditions will apply independently. If a court or competent authority decides that any of the paragraphs of the agreement is invalid or unenforceable, the remaining terms and conditions shall remain in full force and effect.
If FOREVER RUNNING does not enforce any of its obligations under these terms and conditions or does not exercise its rights against you, or if it waits to exercise those rights, that does not mean that it is thereby waiving its rights against you, nor that you are not required to comply with your obligations. If FOREVER RUNNING waives its rights in case of default on your part, it will only do so in writing and this will not mean that it thereby also waives its rights in case of possible subsequent defaults on your part.

14. APPLICABLE LAW

These general terms and conditions and any disputes arising out of these general terms and conditions, including disputes concerning their validity or arising from the use of the website or from any possible purchase through the website are governed by Dutch law.
